Prior research on the psychology of retribution is complicated by the difficulty of separating retributive and general deterrence motives when studying human offenders . We isolate retribution by investigating judgments about punishing animals, which allows us to remove general deterrence from consideration. Studies 2 and 3 document a “victim identity” effect, such that the greater the perceived loss from a violent animal attack, the greater the belief that the culprit deserves to be killed. Study 3 documents a “targeted punishment” effect, (...) such that the responsive killing of the actual “guilty” culprit is seen as more deserved than the killing of an almost identical yet “innocent” animal from the same species. Studies 4 and 5 extend both effects to participants' acceptance of inflicting pain and suffering on the offending animal at the time of its death, and show that both effects are mediated by measures of retributive sentiment, and not by consequentialist concerns. Courts and jurors sometimes refuse to assign liability to defendants on the basis of statistics alone, despite their apparent reliability. I argue that this refusal is best understood as a recognition of defendants’ right to security. Understood as a robust good in Philip Pettit’s sense, security requires that someone risking harm to others’ protected interests adopt a disposition of concern that controls against wrongfully harming them. Since trials risk harm, the state must adopt such a disposition. Statistics leave open the (...) possibility of innocence and so wrongful harm in a way that the state cannot ignore; if it does use such statistics, it makes defendants wrongfully insecure. This explanation of the problem of bare statistical evidence is especially apt because security grounds the right to a fair trial and judicial procedural rights more generally. (shrink)

We show that if among the tested hypotheses the number of true hypotheses is not equal to the number of false hypotheses, then Neyman-Pearson theory of testing hypotheses does not warrant minimal epistemic reliability (the feature of driving to true conclusions more often than to false ones). We also argue that N-P does not protect from the possible negative effects of the pragmatic value-laden unequal setting of error probabilities on N-P’s epistemic reliability. Most importantly, we argue that in the case (...) of a negative impact no methodological adjustment is available to neutralize it, so in such cases the discussed pragmatic-value-ladenness of N-P inevitably compromises the goal of attaining truth. Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. Attempts to understand farmer conservation behavior based on quantitative socio-demographic, attitude, and awareness variables have been largely inconclusive. In order to understand fully how farmers are making conservation decisions, 32 in-depth interviews were conducted in the Eagle Creek watershed in central Indiana. Coding for environmental attitudes and practice adoption revealed several dominant themes, representing multi-dimensional aspects of environmental attitudes. Farmers who were motivated by off-farm environmental benefits and those who identified responsibilities to others (stewardship) were most likely to adopt conservation (...) practices. Those farmers who focused on the farm as business and were most concerned about profitability were less likely to adopt practices. The notion of environmental stewardship in particular was found to be much more complex than the way it is traditionally measured in quantitative studies. The interplay between on-farm and off-farm benefits to practice adoption is an issue that quantitative studies largely do not address. This study seeks to increase understanding of farmers’ environmental attitudes and the connections to conservation behavior. (shrink)

In this article I have two primary goals. First, I present two recent views on the distinction between knowledge-that and knowledge-how (Stanley and Williamson, The Journal of Philosophy 98(8):411–444, 2001; Hetherington, Epistemology futures, 2006). I contend that neither of these provides conclusive arguments against the distinction. Second, I discuss studies from neuroscience and experimental psychology that relate to this distinction. Having examined these studies, I then defend a third view that explains certain relevant data from these studies by positing the (...) double dissociation of knowledge-that and knowledge-how and that is also able to do explanatory work elsewhere. We analyse the issue of using prior information in frequentist statistical inference. For that purpose, we scrutinise different kinds of sampling designs in Jerzy Neyman’s theory to reveal a variety of ways to explicitly and objectively engage with prior information. Further, we turn to the debate on sampling paradigms (design-based vs. model-based approaches) to argue that Neyman’s theory supports an argument for the intermediate approach in the frequentism vs. Bayesianism debate. We also demonstrate that Neyman’s theory, by allowing non-epistemic values (...) to influence evidence collection and formulation of statistical conclusions, does not compromise the epistemic reliability of the procedures and may improve it. This undermines the value-free ideal of scientific inference. (shrink)

Exclusionary defeat is Joseph Raz’s proposal for understanding the more complex, layered structure of practical reasoning. Exclusionary reasons are widely appealed to in legal theory and consistently arise in many other areas of philosophy. They have also been subject to a variety of challenges. I propose a new account of exclusionary reasons based on their justificatory role, rejecting Raz’s motivational account and especially contrasting exclusion with undercutting defeat. I explain the appeal and coherence of exclusionary reasons by appeal to commonsense (...) value pluralism and the intermediate space of public policies, social roles, and organizations. We often want our choices to have a certain character or instantiate a certain value and in order to do so, that choice can only be based on a restricted set of reasons. Exclusion explains how pro tanto practical reasons can be disqualified from counting towards a choice of a particular kind without being outweighed or undercut. (shrink)

Climate change is expected to increase the frequency and intensity of drought in many parts of the world, including Montana. In the face of worsening drought conditions, agricultural producers need to adapt their operations to mitigate risk. This study examined the role of local knowledge and climate information in drought-related decisions through five focus groups with Montana farmers and ranchers. We found that trust and risk perceptions mediated how producers utilized both local knowledge and climate information. More specifically, producers relied (...) on local knowledge in drought-related decisions, regarding their own observation and past experience as trustworthy and not particularly risky. In contrast, climate information and seasonal climate forecasts in particular were regarded as risky and untrustworthy, largely due to a perceived lack of accuracy. Since producers tended to be risk averse, especially given market and climate uncertainties, they rarely relied on “risky” climate information. At the same time, producers actively managed risk and tested out new technologies and practices through processes of trial and error, what they called “experimenting,” which enabled them to build firsthand knowledge of potential adaptations. In the context of uncertainty and risk aversion, programs that reduce the financial risk of experimenting with new technologies and adaptive practices are needed to enable producers to develop direct experience with innovations designed to mitigate drought risk. Further, scientists developing climate information need to work directly with farmers and ranchers to better integrate local knowledge into climate information. (shrink)

In this perspectives article, we maintain that the current local to global sustainable development predicaments we face are the result of humanity's impact on the Earth System (ES)—that is to say, on the very systemic fabric of the ES (i.e., its functioning and configuration), combined with an insufficiently coherent application of sustainable development policy to address and resolve this systemic problem. In response to what is an urgent crisis, we propose four foundational guiding principles, which we contend provide an overarching (...) framing that, if implemented, would offer an approach to steer global sustainable development policy in a manner that would be to the benefit of the ES and the securing of a flourishing future for all. Our principles are applicable at the levels from a local business ecosystem, national‐regional networks, to global policy. (shrink)

I investigate the extent to which perspectival realism agrees with frequentist statistical methodology and philosophy, with an emphasis on J. Neyman’s views. Based on the example of the stopping rule problem, I show how PR can naturally be associated with frequentist statistics in general. I also show that there are some aspects of Neyman’s thought that seem to confirm PR and others that disconfirm it. I argue that epistemic PR is consistent with Neyman’s frequentism to a satisfactory degree and that (...) on the grounds of Neyman’s frequentist methodology one is dealing with genuine and non-trivial perspectives. I also argue that universality and normativity of PR are weakened when analysed from the point of view of Neyman’s statistical methodology. (shrink)

We applaud the goals and execution of the target article, but note that individual differences do not receive much attention. This is a shortcoming because individual differences can play a vital role in theory testing. In our commentary, we describe programs of research of this type and also apply similar thinking to the mechanisms proposed in the target article.

Political legitimacy is best understood as one type of a broader notion, which I call institutional legitimacy. An institution is legitimate in my sense when it has the right to function. The right to function correlates to a duty of non-interference. Understanding legitimacy in this way favorably contrasts with legitimacy understood in the traditional way, as the right to rule correlating to a duty of obedience. It helps unify our discourses of legitimacy across a wider range of practices, especially including (...) the many evaluations we increasingly make of international institutions of various sorts, but also including domestic institutions. The essays collected in this special issue explore what legitimacy means for actors and institutions that do not function like traditional states but nevertheless wield significant power in the global realm. They are connected by the idea that the specific purposes of non-state actors and the contexts in which they operate shape what it means for them to be legitimate and so shape the standards of justification that they have to meet. In this introduction, we develop this guiding methodology further (...) and show how the special issue’s individual contributions apply it to their cases. In the first section, we provide a sketch of our purpose-dependent theory of legitimacy beyond the state. Standard accounts of civil disobedience include nonviolence as a necessary condition. Here I argue that such accounts are mistaken and that civil disobedience can include violence in many aspects, primarily excepting violence directed at other persons. I base this argument on a novel understanding of civil disobedience: the special character of the practice comes from its combination of condemnation of a political practice with an expressed commitment to the political. The commitment to the political is a commitment to engaging with (...) others as co-members in the on-going political project of living together. I show how such an understanding of civil disobedience is superior to the Rawlsian strain of thought, which focuses on fidelity to law. Rawls was concerned with civil disobedience solely in the context of overriding political obligation. The project of characterizing a contestatory political practice that can be distinguished and used in a wider variety of contexts than Rawls is concerned with, including under illegitimate regimes, beyond the nation-state, or on behalf of anarchism, requires a different understanding of civil disobedience. In Morality and Socially Constructed Norms, Valentini searches for a unifying principle that underlies whatever genuine obligations we might have to obey the norms of any and all social practices, ranging from line queueing norms, through offsides rules in soccer, to obligations not to break the law. I argue that this search is driven, and distorted, by a commitment to what Bernard Williams labeled the ‘morality system’. Once we see this, we should question the value of the unifying project. Most (...) social norms can be considered on their own terms, as part of a rich and variegated ethical life, without subsuming them under the question of whether others’ moral rights are at stake. Similarly, political obligation needs to be understood in relation to the practical activity of politics, not as an abstract moral quandary. (shrink)

Margaret Cavendish is widely known as a materialist. However, since Cavendishian matter is always in motion, “matter” and “motion” are equally important foundational concepts for her natural philosophy. In Philosophical Letters (1664), she takes to task her materialist rival Thomas Hobbes by assaulting his account of accidents in general and his concept of “rest” in particular. In this article, I argue that Cavendish defends her continuous-motion view in two ways: first, she claims that her account avoids seeing accidents as capable (...) of generation and annihilation, which she argues is inconceivable; and second, she contends that according to Hobbes’s own view “rest” is an absurd conception since it cannot be drawn from experience. Beyond its function as a defense, I claim that Cavendish’s focused criticism of “rest” shows that she is a perceptive reader of Hobbes’s natural philosophy, insofar as her criticisms undercut the two a priori principles of Hobbesian physics. Finally, I show how her views developed in more detail in Philosophical and Physical Opinions (1663) and Observations upon Experimental Philosophy ([1666] 2001) avoid the worries she raises for Hobbesian materialism.
